These Terms of Service ("Terms") govern your access to and use of eyeform: the mobile application, website, and related services (together, the "Service") operated by the eyeform team ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 16 years old and able to form a binding contract to use eyeform. The Service is intended for professional lash technicians and related beauty professionals.
2. Your account
- You are responsible for keeping your login credentials confidential and for all activity on your account.
- You must provide accurate information during sign-up and keep it current.
- Notify us promptly if you suspect unauthorised access to your account.
3. Your content and your clients
eyeform stores the client records you enter. You retain all rights to the information and photos you upload ("Your Content"). You grant us a limited licence to host, process, and display Your Content solely so that we can provide the Service to you.
You represent that you have the legal right to store and process every piece of Your Content, including consent from your clients to keep their contact details, photos, allergy information, and session notes in the app, as required by your local law. You are solely responsible for obtaining that consent.
4. Acceptable use
You agree not to:
- Use the Service for anything unlawful, deceptive, or harmful to others.
- Upload content that is obscene, defamatory, or infringes someone else's rights.
- Attempt to access other users' data, reverse-engineer the Service, interfere with its security, or overwhelm it with automated traffic.
- Use the Service to send unsolicited commercial messages to your clients.
- Resell, sublicense, or provide the Service to third parties as a hosted solution.
5. Subscription and fees
Some features of the Service may be offered under a paid subscription. Pricing, billing cycle, and renewal terms will be shown at the point of purchase. Subscriptions purchased through the Apple App Store or Google Play are managed by those stores under their respective terms.
6. Availability and changes
We work to keep the Service running, but we cannot guarantee uninterrupted access. We may add, change, or remove features over time. If we make a material change that reduces functionality you have paid for, we will notify you.
7. Termination
You can stop using the Service at any time by deleting your account (see our account deletion page). We may suspend or terminate your access if you materially breach these Terms or if continuing to provide the Service to you would expose us or our users to legal or security risk. If we terminate your account, we will give you a reasonable opportunity to export Your Content when circumstances allow.
8. Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that data loss will never occur, so please keep your own backups if your records are business-critical.
9. Limitation of liability
To the maximum extent permitted by law, neither eyeform nor its operators will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim, or USD 100, whichever is greater.
10. Indemnification
You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, made by a third party (including any of your clients) arising out of Your Content, your use of the Service, or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction where the eyeform team is established, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the courts of that jurisdiction, unless applicable consumer-protection law in your country grants you the right to bring a claim locally.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
